Terms & Conditions of Sale and Use

These Terms & Conditions ("Terms") apply to the services provided by Alphanso Innovations Private Limited, a company incorporated in India under CIN U58201GJ2024PTC148324, with its registered office at: 1107, RK Prime, Near Nana Mava, Rajkot, Gujarat, India, 360005 ("YoTix", "we", "us", "our").
By using our services or purchasing tickets on www.yotix.in, you agree to these Terms, including any additional terms applicable to specific events and services.
1INTRODUCTION
1.1 - We operate a ticketing platform where you can purchase event tickets and other related items. “Ticket(s)” refers to primary event tickets directly allocated to us by event organisers (“Event Partners”).
1.2 - These Terms apply to all ticket purchases made through YoTix, and by purchasing, you agree to be bound by them along with any event-specific terms
1.3 - We act solely as an agent for Event Partners. We are not responsible for organising or delivering the events.
1.4 - Ticket availability, pricing, and types of offerings (e.g., upsells, collector tickets, packages) are determined by the Event Partners.
1.5 - Tickets are sold via multiple sales channels (website, mobile, outlets, etc.) and access the same central inventory.
1.6 - Products such as parking, merchandise, and premium experiences may be offered in addition to tickets (“Upsells” and “Packages”).
1.7 - All products and services offered (including Tickets, Upsells, and Packages) are collectively referred to as “Items.”
1.8 - Tickets are non-refundable except as specified in Clause 10.
1.9 - Our Terms do not apply to purchases made from third parties.
2ACCOUNT & REGISTRATION
2.1 - You must be 18+ or have guardian consent to register an account.
2.2 - You are responsible for safeguarding your account credentials.
2.3 - Corporate users must have legal authority to act on behalf of their organisation.
2.4 - Refer to our Privacy Policy and Cookie Policy for data handling.
2.5 - Misuse or circumvention of account rules may lead to suspension.
2.6 - You must not use our services for unlawful purposes.
2.7 - We may terminate your account for abusive, fraudulent, or unauthorized activity, or legal violations.
2.8 - You can close your account after your ticketed events conclude.
2.9 - Termination does not affect rights or obligations accrued up to that date.
3LEGALLY BINDING CONTRACT
3.1 - Purchases form a legal contract once confirmed.
3.2 - You agree to be bound by these Terms, event-specific terms, and venue conditions.
3.3 - Terms may be updated. Your continued use implies acceptance of changes.
4PRICES, PAYMENTS, AND ORDERS
4.1 - Prices are GST-inclusive unless otherwise stated.
4.2 - Errors in pricing will be corrected by offering a refund or price adjustment.
4.3 - Ticket prices may fluctuate based on demand.
4.4 - Discounts (e.g. student/senior) require valid ID.
4.5 - Foreign currency purchases are subject to exchange and bank fees.
4.6 - Supported payment methods include cards, wallets, UPI, and more.
4.7 - Your contract ends after the event or product delivery.
4.8 - You are responsible for confirming your order. Missed confirmations do not imply order failure.
4.9 - We reserve the right to cancel unpaid or unverifiable orders.
4.10 - Bots or automated purchase methods are prohibited.
4.11 - Anti-fraud checks may delay or cancel suspicious orders.
4.12 - Read item descriptions carefully—mistakes may not be correctable.
4.13 - Venue seating layouts are indicative only.
5DELIVERY
5.1 - Dispatch timelines vary per event and inventory availability.
5.2 - Contact us if tickets haven’t arrived 5 days before the event.
5.3 - Ensure accurate delivery address and availability to receive.
5.4 - Print-at-home ticket users must ensure successful download.
5.5 - Failed delivery due to user error will not be refunded.
5.6 - We may require you to collect tickets at the venue with a valid ID.
5.7 - Inspect tickets upon receipt and report issues within 5 days.
5.8 - Upsell fulfilment lies with Event Partners unless otherwise stated.
6TICKET TRANSFER
6.1 - Transfer functionality may be available through your YoTix account.
6.2 - Transfers are for friends/family and do not change the legal buyer.
6.3 - Tickets cannot be reclaimed once transferred and accepted.
6.4 - Only Tickets (not Upsells or Packages) can be transferred.
6.5 - We may cancel transferred tickets suspected of misuse.
6.6 - Only the original purchaser can claim refunds for transferred tickets.
6.7 - We are not liable to the recipient of a transferred ticket.
7TICKET RIGHTS & RESTRICTIONS
7.1 - Tickets remain the property of the Event Partner.
7.2 - Keep your tickets safe. Damaged/lost tickets may not be reissued.
7.3 - You may be charged a fee for ticket reissuance (if available).
7.4 - Seat allocation may change at the organiser’s discretion.
7.5 - Ticket purchase limits apply per user/card/household.
7.6 - Restricted tickets (e.g. age-restricted, obstructed view) will be noted during purchase.
7.7 - Unauthorized resale, packaging, or promotion is strictly prohibited.
8EVENT ADMISSION
8.1 - Timings and performance details may change.
8.2 - Venue and partner terms apply for all attendees.
8.3 - Entry may be denied for breaching rules or due to safety concerns.
8.4 - No re-entry or pass-outs unless specified.
8.5 - Recording, drones, or prohibited items may lead to ejection.
8.6 - Attending implies consent to being recorded or photographed.
8.7 - Some events may feature loud sounds or visual effects unsuitable for all.
9CANCELLATIONS, REFUNDS, CHANGES
9.1 - We will inform you of cancellations or changes where possible.
9.2 - Full cancellation of an event allows for a refund of the ticket price.
9.3 - Rescheduled events allow refund requests within a specified window.
9.4 - “Material Alterations” trigger refund eligibility.
9.5 - Refunds are processed via original payment methods.
9.6 - Partial refunds may apply for multi-day events.
9.7 - Upsells and Secure Ticket upgrades are non-refundable unless stated.
9.8 - Refunds depend on funds received from the Event Partner.
10DISCLAIMERS & LIMITATIONS
10.1 - We are not liable for losses not directly caused by us.
10.2 - Force majeure events limit our obligations.
10.3 - We are not liable for lost enjoyment, emotional distress, or inconvenience.
10.4 - Maximum liability is limited to the original purchase value.
11INTERPRETATION
11.1 - Terms such as “including”, “include”, “in particular”, “e.g.” shall be construed as illustrative and not limit the preceding text.
11.2 - Headings are for reference only and do not affect interpretation.
11.3 - Capitalised terms shall carry the meanings as defined in these Terms.
12WARRANTIES AND INDEMNITIES
12.1 - You warrant that all information submitted is accurate, and that you are of legal age or have obtained appropriate guardian consent.
12.2 - You agree to comply with all applicable laws and these Terms in your use of YoTix services.
12.3 - You agree to indemnify Alphanso Innovations Pvt. Ltd. and its affiliates, officers, and agents against any loss or liability arising from your breach of these Terms or applicable laws.
13LIMITATION OF LIABILITY
13.1 - We are not liable for loss, damage, or injury unless caused by our negligence or breach of legal duty.
13.2 - We are not liable for indirect or consequential losses, including but not limited to lost profits, goodwill, or enjoyment.
13.3 - Our liability in any event is limited to the total price paid for the Items (excluding Order Processing Fees).
13.4 - We are not responsible for internet connectivity issues or failures by event partners, venues, or promoters.
13.5 - We are not liable for personal injury or property damage unless due to our proven negligence.
13.6 - We are not liable for delays or failures due to force majeure events.
13.7 - Nothing excludes liability for death, injury due to negligence, or fraud where exclusion is not legally permitted.
14QUERIES, COMPLAINTS AND DISPUTE RESOLUTION
14.1 - We will communicate with you via your YoTix account or the email provided at checkout. Keep your details updated.
14.2 - For issues, contact us quoting your order reference.
14.3 - Complaints will be acknowledged within five business days.
14.4 - We may consult Event Partners for resolution.
14.5 - All parties agree to negotiate disputes in good faith before escalating further.
14.6 - Complaints related to the Event or Venue are the responsibility of the Event Partner.
14.7 - Aggressive or abusive behaviour toward staff will not be tolerated. We may restrict your access to services accordingly.
15GENERAL TERMS
15.1 - Failure to enforce any part of these Terms does not waive our right to enforce it later.
15.2 - We may assign these Terms without affecting your rights.
15.3 - If any clause is found invalid, it will not affect the remaining provisions.
15.4 - These Terms will remain enforceable to the fullest extent allowed by law.
15.5 - Our affiliates, successors, or Event Partners may enforce these terms under applicable third-party rights laws.
15.6 - These Terms do not establish agency, partnership, or joint venture between you and us.
15.7 - Notices shall be deemed delivered when received, including by email.
15.8 - These Terms are governed by the laws of India, and any disputes shall fall under the exclusive jurisdiction of the courts in Rajkot, Gujarat.
